『法学セミナー』2011年3月号（日本評論社）の書評欄に昨年11月に刊行された好井裕明編著『差別と排除の[いま]第６巻：セクシュアリティの多様性と排除』（明石書店　2310円）の書評が掲載されました。

無署名の短い書評ですが、本質をとらえた鋭い書評で、同書に掲載した私の論文「トランスジェンダーをめぐる疎外・差異化・差別」で言いたかったことを、きちんと受け止めてくださり、とてもうれしいです。

善意の差別

今、テレビを通じて多様なセクシュアリティをもつ人々を目にする機会が増えている。だがその事を、性的マイノ
リティに対する社会の側の受容として片づけうるのか。実は、性的マイノリティの多様化に伴い、彼・彼女らを囲い込み、排除する「差別の仕組み」も複雑な様相を呈している。本書の主眼は、そうした差別を生みだす構造的要因の検討を通じて、共生への手がかりを探ることにある。性的マイノリティを「性同一性障害」という精神疾患にカテゴライズすることで、一番安心しているのは誰か。このような社会の受容がなされる一方で、障害として診断されることを拒否する人々は、いかなる立場に置かれているだろうか。筆者たちの長年にわたる調査と考察から明らかにされるのは、社会の側の寛容に潜むこうした欺瞞なのだ。そして、問うているのは、この受容を装った差別行為にあなたは（善意で）加担していないか、である。

トランスジェンダーをめぐる差別の再生産を扱った三橋順子さんの論文では、性同一性障害に対する認識の広がりが、非GIDのトランスジェンダーを社会的に疎外し、無化することが論じられている。性同一性障害関係の掲示板にあったという、「差別されたくなかったら、GIDになればいい」という言葉は、とてもショッキングだ。性同一性障害に関する言説や「認定」が、差別の再生産の構造を作る。「性を変えて生きようとする人が、すべて性同一性障害であるかのような認識」を医療や法、政治、そして社会が作りだしていることを、私たちは何度も確認しなければならない。

性を変えて生きようとすることを、「性同一性障害」という精神疾患に囲い込みことで解決しようとする考え方は基本的な部分に大きな間違いがある、という認識が、徐々社会に広まっていることを感じます。
